Was Avery guilty or innocent?
In April 2002, the Wisconsin Innocence Project had hairs tested from the crime scene. DNA from the hairs belonged to Gregory Allen, a felon who resembled Avery and was already serving a 60-year sentence for another sexual assault. Avery was exonerated and released from prison in September 2003.
Avery is currently being held at Fox Lake Correctional Institution, a medium-security prison, where he was transferred in June after years at the maximum-security Waupun Correctional Institution.
An evidentiary hearing will give her a chance to convince the judge that Avery's first-degree murder conviction in the Oct. 31, 2005 death of free-lance photographer Teresa Halbach warrants a new trial for her client. Avery along with his nephew Brendan Dassey were convicted of the murder.

Ultimately, Avery settled the lawsuit for $400,000. He needed money to hire attorneys Jerry Buting and Dean Strang to mount a vigorous murder defense. Avery was imprisoned from 1985 to 2003 for a rape and brutal beating he did not commit.

Dolores Avery, the mother of Making a Murderer subject Steven Avery, has died, aged 83. The news was announced by Steven's lawyer, Kathleen Zellner, who appeared in the second season of the true-crime documentary series. Dolores died on Thursday (8 July), one day before Steven's 59th birthday.

The murder of Teresa Sievers occurred on June 28, 2015, when she was attacked at her home in Bonita Springs, Florida by two men who bludgeoned her to death with a hammer, striking her a total of seventeen times. Police arrested two men from Missouri for the crime: Curtis Wayne Wright Jr. and Jimmy Ray Rodgers.

While Avery's father is alive and well into his 80s, sadly his mother Dolores passed away at 6:50am on 8th July, 2021. The news was announced by Avery's lawyer, Kathleen Zellner, on Twitter.
